Selling CVV Data Is Card Fraud Under Federal Law

Short answer

Selling CVV numbers is a federal crime in the United States. The CVV is part of a payment card account. A card number, expiration date, and CVV together form an access device under 18 U.S.C. 1029. Trading that data is access device fraud. I will not name markets, sellers, or version numbers of any site. That information is used to commit card fraud, and publishing it would help a crime.

What the law covers

18 U.S.C. 1029 covers producing, selling, transferring, and possessing access devices with intent to defraud. It also covers trafficking in the data itself, even without a completed purchase. A first offense carries up to 10 years in prison. Aggravated conduct, such as trafficking in 15 or more devices, raises the maximum to 15 years. Courts can add fines and restitution.

State laws add charges. Most states treat card data trafficking as a felony. Prosecutors often stack identity theft counts on top of the access device counts.

  • The FBI and U.S. Secret Service run card fraud cases.
  • The DOJ prosecutes them in federal court.
  • The FTC handles identity theft complaints and consumer reporting.
  • Card networks run their own fraud teams and share data with police.

What happens to buyers

Buyers face the same access device charges as sellers in most prosecutions. Using a stolen CVV to buy goods adds wire fraud and mail fraud counts. Package interception adds theft counts. Sentences build from the total loss figure.

Report the theft to your card issuer. Request a new card number. File a report at IdentityTheft.gov and keep the record. Dispute charges you did not make. Federal law limits your loss on credit cards to $50, and most issuers waive it.
