CVV Explained: Why Buying Card Data Is a Federal Crime

What a CVV is

A CVV is a 3 or 4 digit code printed on a payment card. Visa, Mastercard, and Discover cards carry a 3 digit code on the back. American Express uses a 4 digit code on the front. Card networks also call it CVV2, CVC2, or CID. The issuer generates the code. It is not written to the magnetic stripe and it is not stored in the chip.

What the code does

Merchants ask for the CVV in card-not-present transactions, such as online orders and phone orders. The code shows the buyer holds the physical card. A correct CVV raises the approval rate. A wrong CVV can trigger a decline.

Buying CVV data is a federal crime

Card data sold as "CVV" on forums, chat apps, and darknet markets is stolen. Sellers pull it from breaches, skimmers, and phishing pages. Buying or selling that data violates 18 U.S.C. § 1029, which covers access devices. A first conviction carries up to 10 years in prison and fines up to $250,000. Prosecutors can add wire fraud, identity theft, and money laundering counts.

Why the listings fail on their own terms

  • Many records are invalid or already blocked by the issuer.
  • Buyers send funds with no recourse. Police reports on these deals are rare because both sides broke the law.
  • Networks and banks watch for card-testing patterns and close accounts.

Where card data leaks

  • Skimmers on fuel pumps and ATMs.
  • Phishing pages that copy a bank login screen.
  • Merchant breaches. CISA and the FBI publish incident reports on these.
  • Malware on a phone or computer that reads stored card data.

How to protect a card

  1. Use a virtual card number for online merchants when the issuer offers one.
  2. Turn on transaction alerts in the bank app.
  3. Check the reader and the pump seal before paying.
  4. Report a lost card and request a new number.

If a card number is exposed

Call the issuer. The number on the back of the card reaches the fraud line. The issuer can freeze the account and mail a new card. File a report at IdentityTheft.gov, run by the FTC. Complaints about internet-facilitated card fraud go to the FBI's Internet Crime Complaint Center.
