Selling or Buying CVV Data Is a Federal Crime

Short answer

There is no legal market for CVV data. A CVV is the 3 or 4 digit code printed on a payment card. Selling, buying, or trading that code together with a card number is trafficking in an unauthorized access device under 18 U.S.C. 1029. It is a federal felony, not a gray area.

What the statute covers

  • 18 U.S.C. 1029: producing, selling, transferring, or possessing card numbers and CVVs with intent to defraud.
  • 18 U.S.C. 1028A: aggravated identity theft, which adds a mandatory 2 year term stacked on the underlying sentence when a stolen identity is used.
  • State law: most states charge card fraud and identity theft as separate offenses on top of federal counts.

Penalties

Federal sentences under Section 1029 run up to 10 or 15 years depending on the subsection and prior convictions. Courts order restitution to victims. The Secret Service, FBI, and card issuers investigate these cases.

Card issuers and card networks do not license CVV resale. Any site, forum, or chat channel offering CVV data for sale is either moving stolen data or running a scam against the buyer. Buyers of stolen card data have been charged as co-conspirators.
